Breach of Fiduciary Duty (Failure of Executors)

In many estates, it is common for an executor to take charge, file the paperwork, and leave the beneficiaries and would-be beneficiaries in the dark.  While we counsel our executors to be forthcoming and transparent about estate business, many executors are not.  We assist beneficiaries in enforcing their rights to be heard, their rights to property, and their rights to information.

Even if no wrongdoing is suspected or expected, it can be useful, especially in more complex estates with multiple beneficiaries, to retain your own legal counsel to review court documents and letters and explain the process to you.

If wrongdoing or negligence is occurring, then it is important for you to know what options you have for correcting it.  If you need assistance with enforcing your rights as a beneficiary or heir of an estate, please call us to schedule an office consultation so we can review the facts with you and assist you towards a resolution.
